Terms & Conditions – NammaCoders LLP

1. Acceptance of Terms

By accessing or using the website, services, or products provided by NammaCoders LLP ("Company", "we", "us", "our"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

Continued use of our services constitutes acceptance of any updates to these terms.

2. Scope of Services

NammaCoders LLP provides, but is not limited to, the following services:

  • Website design and development
  • Software and SaaS product development
  • Hosting (only where explicitly stated)
  • Maintenance and support (as per selected plan)
  • Consulting, analytics, and AI-based solutions

Any service not explicitly mentioned in a proposal, invoice, or plan description is not included.

3. User Accounts & Responsibilities

  • Users must provide accurate and complete information while registering or availing services
  • Users are responsible for maintaining the confidentiality of login credentials
  • NammaCoders LLP is not responsible for unauthorized access resulting from user negligence

4. Payments, Billing & Pricing

  • All fees are displayed on the website or shared via official quotation
  • Payments are processed through authorized third-party payment gateways (e.g., Razorpay)
  • Applicable taxes (including GST) will be charged as per Indian law
  • Prices are subject to change with prior notice

Unless explicitly mentioned, all payments are non-refundable.

5. Subscriptions, Renewals & Cancellation

  • Subscription services are billed monthly or annually as selected
  • Cancellation requests must be raised before the next billing cycle
  • Services remain active until the end of the paid period
  • No refunds for partially used subscription periods

6. Refund Policy

Refunds, if applicable, are governed strictly by the specific service agreement or proposal. Unless otherwise stated:

  • No refunds after project work has started
  • No refunds on completed milestones
  • No refunds on subscription fees already paid

7. Intellectual Property Rights

  • All intellectual property, frameworks, templates, and reusable components developed by NammaCoders LLP remain our property
  • Final deliverables are transferred to the client only after full payment
  • Clients may not resell, distribute, or reuse proprietary components without written consent

8. Data Privacy & Security

We process data in accordance with:

  • Information Technology Act, 2000
  • IT (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011

While reasonable security measures are implemented, absolute security is not guaranteed.

9. Service Availability & Downtime

  • Services are provided on an "as-is" and "as-available" basis
  • No guarantee of uninterrupted or error-free service
  • Downtime may occur due to maintenance or third-party dependencies

10. Prohibited Use

Users must not:

  • Use services for unlawful purposes
  • Attempt security breaches
  • Reverse engineer or copy software
  • Abuse APIs or infrastructure
  • Engage in spamming or malicious activities

Violations may lead to immediate termination.

11. Limitation of Liability

To the maximum extent permitted under Indian law:

  • NammaCoders LLP is not liable for indirect or consequential damages
  • Total liability shall not exceed payments made in the preceding three (3) months

12. Indemnification

Users agree to indemnify NammaCoders LLP against claims arising from:

  • Misuse of services
  • Legal violations
  • Breach of these Terms

13. Third-Party Services

We are not responsible for failures, policies, or availability of third-party services integrated with our platform.

14. Termination of Services

We may suspend or terminate services without notice if:

  • Terms are violated
  • Payments are overdue
  • Services are misused

Outstanding payment obligations remain enforceable.

15. Force Majeure

NammaCoders LLP is not liable for delays or failures due to events beyond reasonable control.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of India.

Courts in Mandya, Karnataka, India shall have exclusive jurisdiction.

17. Modifications to Terms

We may update these Terms at any time.

Continued use constitutes acceptance of updated terms.
